Rubbish Removal Enfield Service Terms and Conditions
These Terms and Conditions set out the basis on which Rubbish Removal Enfield provides rubbish removal, waste collection and related services. By placing a booking, accepting a quotation, or allowing our operatives to commence work, you agree to be bound by these Terms and Conditions.
1. Definitions
In these Terms and Conditions, the following expressions have the meanings set out below:
Customer means the individual, business, organisation or other party who requests or receives services from Rubbish Removal Enfield.
Services means rubbish removal, waste collection, clearance, loading, transport, disposal and any related services provided by Rubbish Removal Enfield.
Waste means all items, materials, goods or substances presented for removal or disposal as part of the Services, including household rubbish, commercial waste, garden waste and bulky items, but excluding any prohibited or hazardous materials as defined in these terms or by law.
Agreement means the contract between Rubbish Removal Enfield and the Customer for the provision of Services, incorporating these Terms and Conditions and any quotation or written confirmation.
2. Scope of Services
Rubbish Removal Enfield provides on-demand and scheduled rubbish removal and waste collection services for domestic and commercial customers. The Services may include collection of bagged waste, loose items, furniture, appliances, garden debris and general non-hazardous waste from agreed locations on the Customer’s premises or other sites.
The exact scope of Services, including the type and approximate volume of Waste to be removed, access arrangements, timing and any specific requirements, will be agreed with the Customer at the time of booking or during a pre-arranged site visit. The Services do not include extensive dismantling, demolition, specialist cleaning or gardening works unless specifically agreed in writing.
3. Booking Process
The Customer may request Services by telephone, email or other contact methods made available by Rubbish Removal Enfield. When making a booking request, the Customer must provide accurate and complete information, including:
1. The full address where the Services are required.
2. The type of property or site to be attended.
3. A description of the Waste, including approximate volume and any unusual or heavy items.
4. Any known access restrictions, parking limitations or time constraints.
5. The preferred date and time window for the Service.
Rubbish Removal Enfield may provide an estimated price based on the information supplied at the time of booking. In some cases, a site inspection may be required before the price can be confirmed. The booking is considered provisional until it is confirmed by Rubbish Removal Enfield, which may be done verbally, by email or by sending a written confirmation.
Rubbish Removal Enfield reserves the right to refuse or cancel any booking where it believes that the Services cannot be safely or lawfully carried out, or where the Customer fails to provide adequate information or access.
4. Quotations and Pricing
Any quotation provided is based on the Customer’s description of the Waste and the work required. Quotations are typically given as estimates and may be subject to adjustment on site if:
1. The actual volume or type of Waste differs from that described by the Customer.
2. Additional labour, time or equipment is required to complete the work safely or efficiently.
3. There are access, parking or site constraints not previously disclosed.
Where additional costs are likely to apply, Rubbish Removal Enfield will inform the Customer as soon as reasonably practicable. If the Customer does not accept revised pricing, Rubbish Removal Enfield may decline to proceed or may agree to carry out a reduced scope of work that fits within the original estimate.
All prices are quoted in pounds sterling and may be subject to applicable taxes, charges or fees. Unless expressly stated otherwise, quoted prices include standard labour, loading and disposal costs for non-hazardous Waste.
5. Waste Types and Prohibited Items
The Services are intended for general, non-hazardous Waste. Certain items are restricted or prohibited due to legal, environmental, health and safety or licensing requirements. Prohibited or restricted items may include:
1. Asbestos-containing materials.
2. Clinical or medical waste, including syringes, sharps and pharmaceuticals.
3. Hazardous chemicals, solvents, paints, oils, fuels or pressurised containers.
4. Gas cylinders, fireworks and explosives.
5. Large quantities of tyres, electrical waste or batteries beyond usual household levels without prior arrangement.
6. Any other items classified as hazardous or requiring special disposal under applicable waste regulations.
The Customer must inform Rubbish Removal Enfield in advance if any such items are present. Rubbish Removal Enfield reserves the right to refuse to remove prohibited items, to adjust pricing for special handling, or to require the Customer to arrange separate specialist disposal.
6. Access, Parking and Site Conditions
The Customer is responsible for ensuring safe, reasonable and lawful access to the premises or site where Services are to be provided. This includes:
1. Making sure that Rubbish Removal Enfield has sufficient parking space for vehicles, and that any necessary permits or permissions are in place.
2. Providing clear access routes to the Waste, free from obstructions and hazards.
3. Ensuring that the site is safe for operatives to work, including adequate lighting and, where relevant, accurate information about any known risks.
Any parking charges, congestion charges, tolls or similar fees incurred in providing the Services may be passed on to the Customer. If access is delayed, obstructed or refused, Rubbish Removal Enfield may charge a waiting fee, a call-out charge or a cancellation fee as appropriate.
7. Customer Obligations
The Customer agrees to:
1. Provide truthful and accurate information about the Waste and the premises.
2. Ensure that any Waste presented is owned by the Customer or that the Customer has the legal right to dispose of it.
3. Secure any necessary permissions from landlords, property managers, local authorities or neighbours where applicable.
4. Supervise or ensure that an authorised representative is present at the premises for the duration of the Service where reasonably required.
5. Comply with any reasonable instructions given by Rubbish Removal Enfield for health and safety or operational reasons.
The Customer is responsible for verifying, before removal, that no items of value or items intended to be kept are mixed with the Waste. Rubbish Removal Enfield cannot accept responsibility if belongings are accidentally removed due to being presented as Waste.
8. Payment Terms
Unless otherwise agreed in writing, payment for the Services is due on completion of the work on the day of service. Rubbish Removal Enfield may accept payment by cash, bank transfer, card payment or other methods notified to the Customer.
For business customers or larger projects, Rubbish Removal Enfield may agree credit terms or staged payments. In such cases, payment terms will be set out in the quotation or invoice. Time of payment is of the essence. If any sum remains unpaid after the due date, Rubbish Removal Enfield may:
1. Charge interest on the overdue amount at a reasonable rate consistent with applicable law until payment is received in full.
2. Suspend or refuse further Services until outstanding amounts are paid.
3. Recover from the Customer all reasonable costs and expenses incurred in pursuing the debt, including legal fees.
9. Cancellations and Rescheduling
The Customer may cancel or reschedule a booking by giving reasonable notice. Rubbish Removal Enfield asks that Customers provide at least 24 hours’ notice prior to the scheduled start time wherever possible.
Rubbish Removal Enfield reserves the right to apply cancellation charges where:
1. The Customer cancels on arrival or with less than 24 hours’ notice.
2. The Customer fails to provide access to the premises at the agreed time.
3. The Customer is not present, where their presence is reasonably required, and the work cannot proceed.
Cancellation charges will reflect any costs incurred, including staff time, travel, vehicle costs and lost opportunity. Where Rubbish Removal Enfield needs to cancel or reschedule due to unforeseen circumstances, every effort will be made to offer an alternative appointment as soon as reasonably practicable.
10. Performance of Services
Rubbish Removal Enfield will use reasonable care and skill in providing the Services and will aim to carry out the work within any agreed time window. However, timing is not guaranteed, and the Service may be subject to delays caused by traffic, weather, operational issues, access problems or other factors beyond Rubbish Removal Enfield’s reasonable control.
Operatives will take reasonable steps to avoid damage to property when collecting and removing Waste. The Customer should highlight any particularly delicate areas, surfaces or items that may require special care. Rubbish Removal Enfield cannot be held liable for minor scuffs, marks or wear and tear that are reasonably incidental to the performance of the Services, provided reasonable care is taken.
11. Liability and Limitations
Nothing in these Terms and Conditions limits or excludes liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for any other liability which cannot be excluded or limited by law.
Subject to the above, Rubbish Removal Enfield will not be liable for:
1. Loss or damage arising from inaccurate information supplied by the Customer.
2. Loss of items mistakenly presented as Waste and removed in good faith.
3. Indirect or consequential losses, including loss of profit, loss of business, loss of data or loss of opportunity.
4. Any delay or failure to perform Services due to events beyond its reasonable control, including traffic conditions, severe weather, accidents, or interruptions in third-party services.
Rubbish Removal Enfield’s total aggregate liability for any claim arising out of or in connection with the Services, whether in contract, tort or otherwise, shall be limited to the total price paid or payable by the Customer for the specific Service giving rise to the claim.
12. Compliance with Waste Regulations
Rubbish Removal Enfield is committed to operating in accordance with applicable UK waste management legislation and environmental regulations. Waste will be transported and disposed of only at authorised facilities, and records will be kept in accordance with legal requirements.
The Customer acknowledges that once Waste is collected, it becomes the responsibility of Rubbish Removal Enfield to handle it lawfully. However, the Customer remains responsible for ensuring that the Waste presented does not include prohibited or unlawful materials and that any required documentation, such as waste transfer notes for commercial waste, can be properly completed.
Where required by law, the Customer agrees to provide accurate information about the origin and nature of the Waste and to retain any documentation provided in relation to the transfer and disposal of Waste.
13. Insurance
Rubbish Removal Enfield maintains appropriate insurance cover suitable for its business operations, including public liability insurance. Details of current insurance cover may be made available to Customers upon reasonable request.
14. Complaints and Disputes
If the Customer has any concerns about the Services provided, they should raise the issue with Rubbish Removal Enfield as soon as possible, ideally within 48 hours of completion of the work. Rubbish Removal Enfield will investigate complaints promptly and aim to resolve them fairly, which may include revisiting the site, rectifying issues where practical, or offering a partial refund where appropriate.
If a dispute cannot be resolved directly between the parties, the Customer may seek redress through applicable consumer rights or legal channels. These Terms and Conditions do not affect any statutory rights that cannot be waived or limited by contract.
15. Data Protection and Privacy
Rubbish Removal Enfield may collect and process personal data from Customers in order to manage bookings, provide Services, issue invoices and communicate about work. Personal data will be handled in accordance with applicable data protection laws and will not be sold or disclosed to third parties except where necessary to deliver the Services, comply with legal obligations or enforce this Agreement.
16. Changes to Terms and Services
Rubbish Removal Enfield may update or amend these Terms and Conditions from time to time. The version in force at the time of booking will apply to that Agreement. Any material changes will, where reasonably possible, be communicated to regular or account Customers.
Rubbish Removal Enfield may also modify, suspend or discontinue certain Services due to operational, legal or commercial reasons, but will honour existing confirmed bookings where reasonably practicable.
17. Governing Law and Jurisdiction
These Terms and Conditions, and any dispute or claim arising out of or in connection with them or their subject matter or formation, shall be governed by and construed in accordance with the laws of England and Wales.
The parties agree that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions or their subject matter.
18. General Provisions
If any provision of these Terms and Conditions is found to be invalid, unlawful or unenforceable by a court or competent authority, that provision will be severed from the remaining terms, which will continue to be valid and enforceable.
No failure or delay by Rubbish Removal Enfield in exercising any right or remedy shall constitute a waiver of that right or remedy, nor shall it prevent or restrict any further exercise of that or any other right or remedy.
The Agreement is between Rubbish Removal Enfield and the Customer. No other person shall have any rights to enforce any of its terms.
By proceeding with a booking or by allowing the Services to commence, the Customer confirms that they have read, understood and agree to be bound by these Terms and Conditions.
